1. Amendments to Terms

We reserve the right to modify these Terms at any time. Any changes will take effect immediately upon notice, which may be given through the App or other communication channels. Continued use of the App after such changes constitutes your acceptance.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the App. The App is for personal, non-commercial use only.

By using the App, you represent and warrant that:

• Your access and use is lawful under the laws of your jurisdiction.
• You are not a resident of jurisdictions restricted by applicable laws and sanctions (e.g., United States, China, Iran, North Korea, etc.).

3. Access and Use of the App

Access to the App is temporary and may be withdrawn or amended without notice. We are not liable for any downtime or interruptions.

We may adjust the rate at which users accumulate tokens, and we reserve the right to reverse any rewards mistakenly issued or obtained through misuse, fraud, or breach of these Terms.

You are solely responsible for securing access to your digital wallet and managing your credentials. We provide no warranty that any tokens have real-world or monetary value. Any loss in token value is at your risk.

4. Linked Sites

The App may contain links to third-party websites or services ("Linked Sites"). We have no control over Linked Sites and accept no responsibility for their content, terms, or practices.

5. Privacy Policy

Our Privacy Policy explains how we collect, store, and use your personal information. By using the App, you agree to the terms outlined in our Privacy Policy.

6. Safety Warnings

The App may include features related to health and physical activity. Always consult a medical professional before engaging in any new activity. Use of the App is entirely at your own risk. The information presented is not medical advice.

7. Purchases and Subscriptions

GameByts Coins and other services may be purchased via Apple Pay, Google Play, and other approved platforms. Your External Service account may be charged according to its terms.

Subscriptions auto-renew unless cancelled through your account settings. All purchases are final and non-refundable unless required by applicable EU consumer protection laws.

Chargebacks or reversed payments may result in the termination of your access to the App and loss of associated assets.

8. No Warranties

To the extent allowed by law, the App is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, functionality, or suitability of the App or Services.

9. User Warranties

By using the App, you represent and warrant that you:

• Are medically fit to participate in activities the App may support.
• Will use the App responsibly and lawfully.
• Will not attempt to deceive or mislead others through the App.

10. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Interfere with or disrupt the App's functionality
• Post or distribute harmful, offensive, or infringing content
• Impersonate others or misrepresent yourself
• Use bots, emulators, or automation tools to manipulate gameplay or rewards
• Engage in harassment, defamation, or any abusive behavior

We reserve the right to suspend or ban users who breach these Terms.

11. Intellectual Property

All content in the App is owned by GameByts or licensed from third parties. You may not reproduce, distribute, or create derivative works without our express permission.

You grant GameByts a non-exclusive, irrevocable, worldwide license to use, display, and share content you upload through the App for the purpose of providing and promoting the Services.

12. Anti-Cheating

GameByts incorporates a comprehensive Anti-Cheating System to ensure a fair and secure environment for all users. Our system:

• Restricts users to a maximum of two accounts per physical device
• Tracks hardware component IDs and IP addresses to prevent circumvention
• Monitors mouse and activity patterns to detect and prevent AFK (Away From Keyboard) behavior or automation

Attempts to bypass these systems through hardware spoofing, multiple VMs, or any form of automation may result in suspension, loss of rewards, and permanent account termination. We reserve the right to take further action as necessary to maintain the integrity of the platform.

13. Liability Disclaimer

To the fullest extent permitted by law, we disclaim all liability for indirect, consequential, or incidental damages, including but not limited to loss of tokens, data, or revenue.

This does not affect our liability for personal injury or fraud resulting from our negligence or any liability that cannot be excluded under EU or Romanian law.

14. Linking Policy

You may link to our homepage, provided the link is fair and legal. You must not imply any endorsement or affiliation without our consent.

15. Third-Party Content

Names, brands, or trademarks of third parties mentioned in the App are owned by their respective holders. Their inclusion does not imply endorsement or affiliation.

16. Indemnification

You agree to indemnify and hold harmless GameByts, its directors, staff, and affiliates from any claims arising from your use of the App or any breach of these Terms.

17. Service Modifications

We reserve the right to modify, update, or discontinue the App or its features at any time without liability.

18. Severability

If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.

19. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control.

20. Assignment

You may not transfer or assign your rights under these Terms. GameByts may assign its rights without restriction.

21. Waiver

Any waiver of rights must be in writing and does not imply ongoing waiver of similar rights.

22. No Third-Party Rights

These Terms are between you and GameByts. No third party has rights to enforce any part of these Terms.

23. Governing Law

These Terms are governed by the laws of Romania and applicable EU regulations. Disputes will be subject to the exclusive jurisdiction of Romanian courts.
